ServIndy – Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the ServIndy mobile application, website
at servindy.com, and related services (collectively, the “Service”).
The Service is operated by Tech G Labs LLC, a Texas limited liability company
(“Tech G Labs LLC,” “we,” “us,” or “our”).
By creating an account, accessing, or using ServIndy, you agree to be bound by these Terms.
If you do not agree, you must not use the Service.
1. Eligibility
- You must be at least 18 years old to use ServIndy.
- You represent and warrant that you:
- are at least 18;
- have the legal capacity to enter into a binding contract;
- are using the Service for legitimate work-related or hiring-related purposes;
- are not prohibited from using the Service under applicable law; and
- will comply with these Terms and all applicable laws and regulations, including labor and employment laws that apply to you.

You may not use ServIndy, or upload photos or other content, that depict or involve
any person under the age of 18.
2. Overview of the Service
ServIndy is a job pairing gateway for the service and hospitality industry. The Service is designed to help
working professionals and bands (for example, bartenders, servers, hosts, cooks, barbacks, security, DJs, and live bands)
connect with bars, restaurants, venues, hotels, event companies, and other establishments that are hiring
for gig, part-time, and full-time roles.
ServIndy provides a platform that allows professionals and establishments to discover each other,
exchange information, and communicate. ServIndy does not:
- hire or employ workers;
- set, negotiate, or guarantee wages, tips, or other compensation;
- schedule shifts or manage timekeeping;
- process payroll or remit employment-related taxes; or
- act as an employer of record, staffing agency, joint employer, or representative of any user.
Any employment, contractor, or gig engagement is solely between the professional (or band) and the establishment.
ServIndy is not a party to these relationships and is not responsible for workplace conditions, compliance with labor laws,
or payment of compensation.
ServIndy is a matching and communication platform only and does not provide legal, tax, HR, or other professional advice.
We do not guarantee that you will find a job, shift, candidate, or any particular outcome.
3. Accounts and Registration

To use certain features, you must create an account (for example, as a service professional, band, or establishment).
You may register via email/password or sign-in services such as Apple, when available.

You agree to provide accurate, current, and complete information during registration
and to keep your information current, including your role (professional/band/establishment) and contact details.

You are responsible for maintaining the confidentiality of your login credentials
and for all activities that occur under your account.

You must notify us immediately at support@servindy.com
if you suspect any unauthorized use of your account or any other security breach.
4. Community Rules & User Content
4.1 User Content
You are solely responsible for the content you submit, upload, post, or display on or through
the Service, including profile information, photos, job posts, shift descriptions, availability,
compensation descriptions, messages, and any other materials
(“User Content”).
By providing User Content, you represent and warrant that:
- You own or have the necessary rights to post the User Content and to grant the license below.
- Your User Content is accurate and does not violate these Terms or any applicable law or regulation.

As an establishment, your job postings and hiring practices comply with applicable labor, wage-and-hour,
anti-discrimination, and employment laws.
4.2 License You Grant to Us
By submitting User Content, you grant Tech G Labs LLC a worldwide, non-exclusive,
royalty-free, sublicensable, and transferable license to use, reproduce, modify,
adapt, publish, translate, create derivative works from, distribute, perform,
and display such User Content in connection with operating, improving, and promoting
the Service, including for advertising and marketing ServIndy (subject to applicable law
and our Privacy Policy).
4.3 Prohibited Content
You may not upload, share, or transmit any User Content that:
- Depicts, exploits, or otherwise involves minors or individuals who appear to be under 18.
- Is nude, pornographic, sexually explicit, or otherwise intended primarily to arouse sexual interest.
- Is hateful, harassing, threatening, or incites violence or discrimination against individuals or groups.
- Contains graphic or extreme violence, self-harm content, or encourages suicide or self-injury.
- Depicts illegal activities or promotes illegal drug use or criminal behavior.
- Constitutes spam, scams, fraudulent schemes, or attempts to solicit money or financial information unrelated to legitimate hiring or work opportunities.

Promotes or advertises escorting, prostitution, or other sexual services that violate law or our policies.
- Infringes or violates any intellectual property, privacy, publicity, or other rights of any person.

Contains private or confidential information of others (such as full name combined with home address,
financial information, passwords, or government IDs) without their consent.

As a job post or profile, expresses discriminatory preferences or requirements in violation of applicable law
(for example, discrimination based on race, color, religion, sex, national origin, age, disability, or other protected characteristics).
4.4 No Impersonation or Misrepresentation
- You may not impersonate any person or entity or misrepresent your identity, role, or affiliation.

You may not create or use multiple fake accounts, or otherwise attempt to manipulate visibility,
matching, or job discovery in the Service.
4.5 Our Rights to Moderate and Remove Content
We may, but are not obligated to, monitor, review, or remove User Content at our sole discretion.
We may suspend or terminate accounts, remove content, or otherwise intervene when we believe
these Terms, our policies, or applicable law are being violated, or to protect other users, the
Service, or third parties.
5. Safety; Interactions with Other Users
ServIndy enables professionals, bands, and establishments to interact through profiles, job posts, and messaging.
You are solely responsible for your interactions with other users, both online and offline.

We do not routinely conduct criminal background checks or verify the identity, credentials, licenses,
or work authorization status of every user, unless expressly stated for a specific feature.

We do not guarantee that any user is who they claim to be, that job postings are accurate or lawful,
or that any User Content is complete or up to date.

As a professional or band, you are responsible for evaluating establishments, job offers, and working conditions,
including verifying pay, schedule, and compliance with applicable laws.

As an establishment, you are responsible for evaluating the suitability, qualifications, and eligibility
of professionals and bands, and for complying with all applicable employment and safety laws.

You agree to exercise caution and good judgment when communicating with or meeting other users in person.
Meet in appropriate settings, follow your workplace safety procedures, and do not share sensitive personal
or financial information unless necessary and appropriate.

To the fullest extent permitted by law, Tech G Labs LLC is not responsible for the conduct, acts,
or omissions of any users on or off the Service, for any hiring or firing decisions, or for any personal
or property damage, injury, wage disputes, or harm resulting from your interactions or work engagements
with others.
6. In-App Purchases and Payments
ServIndy may offer optional paid features, subscriptions, or tools (for example, enhanced visibility,
premium hiring tools, or additional profile features). Payment processing may be handled by Apple (via the App Store),
other app stores, and/or authorized payment providers.
- All prices and payment terms are as displayed within the app or relevant store listing.

Purchases may be non-refundable, except as required by applicable law or the policies of the app store
where you made the purchase.

You are responsible for any carrier data charges or other fees associated with your use of the Service.

Paid features do not guarantee any specific number of job opportunities, candidates, or hires.
7. License and Intellectual Property
7.1 Our License to You
Subject to your compliance with these Terms, we grant you a limited, non-exclusive,
non-transferable, non-sublicensable, revocable license to download and use the ServIndy app
on a device that you own or control, and to access and use the Service for your legitimate
work-related or hiring-related purposes.
7.2 Our Intellectual Property
The Service, including its design, text, graphics, logos, icons, images, software, and other content
(excluding User Content), is owned by Tech G Labs LLC or its licensors and is protected by
intellectual property laws. Except as expressly permitted in these Terms, you may not copy,
modify, distribute, sell, or create derivative works based on the Service.
8. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.

Use the Service to stalk, harass, threaten, intimidate, defame, or harm others, or to invade their privacy.

Use any automated means (including bots, scrapers, crawlers, or spiders) to access or interact with the Service,
except as expressly permitted by us in writing.
- Reverse engineer, decompile, or attempt to derive the source code of any software used in the Service.
- Interfere with or disrupt the Service or servers or networks connected to the Service.
- Attempt to circumvent any content moderation, security, or access control features.

Use the Service for commercial purposes unrelated to legitimate work or hiring without our prior written consent,
including advertising other products or services or soliciting users for unrelated business.
9. Third-Party Services and Links
The Service may integrate with or contain links to third-party websites, apps, or services
(for example, sign-in providers, analytics tools, or payment processors). We do not control and are not responsible for
the content, policies, or practices of third parties. Your use of third-party services is subject to
their separate terms and privacy policies.
10. Disclaimers

The Service is provided on an “AS IS” and “AS AVAILABLE” basis,
without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties
of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out
of course of dealing or usage of trade.

We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any defects
will be corrected.

We do not guarantee any particular number of job opportunities, candidates, matches, responses,
successful hires, shifts, or earnings.

We do not supervise, direct, or control the work or services provided by professionals or bands,
or the operations of establishments, and we do not guarantee compliance with labor, wage, or safety laws
by any user.
11. Limitation of Liability
To the fullest extent permitted by law, in no event shall Tech G Labs LLC or its owners, officers,
employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential,
or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly,
or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of, or inability to access or use, the Service;
- Any conduct or content of other users or third parties on or through the Service;
- Any job posting, job offer, shift, or work engagement facilitated (or not facilitated) through the Service;
- Unauthorized access, use, or alteration of your User Content or information; or
- Any other matter relating to the Service.
In no event shall our total liability for all claims relating to the Service exceed the greater of:
(a) the amounts you paid to us, if any, for access to the Service during the six (6) months
immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US $100).
12. Indemnification
You agree to indemnify, defend, and hold harmless Tech G Labs LLC and its officers, directors,
employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses,
including reasonable attorneys’ fees, arising out of or in any way connected with:
- Your access to or use of the Service;
- Your User Content;
- Your hiring, contracting, or work-related decisions or activities;
- Your violation of these Terms; or
- Your violation of any rights of another person or entity.
13. Termination
We may suspend or terminate your access to the Service, or any part of it, at any time and for any reason
(including if you violate these Terms or applicable law), with or without notice and without liability.
Upon termination, all licenses and other rights granted to you in these Terms will immediately cease.
You may stop using the Service and delete your account at any time through the in-app settings,
subject to our data retention practices described in the Privacy Policy.
14. Governing Law; Dispute Resolution
These Terms and any dispute or claim arising out of or related to them or the Service are governed by
the laws of the State of Texas, without regard to its conflict of laws rules.
You agree that any legal suit, action, or proceeding arising out of or related to these Terms or the Service
shall be instituted exclusively in the state or federal courts located in Bexar County, Texas, and you
consent to the personal jurisdiction and venue of such courts.
15. Changes to the Service and to These Terms
We may modify the Service and/or update these Terms from time to time. When we make material changes,
we will update the “Last Updated” date at the top of this page and may provide additional notice as required
by law (for example, via in-app notice).
Your continued use of the Service after the updated Terms become effective constitutes your acceptance
of the changes. If you do not agree, you must stop using the Service.
